500 Designs Privacy Policy

This Privacy Policy explains how 500 Designs LLC (“500 Designs”, “we”, “us” or “our”) collects, uses and shares personal information when you visit 500designs.com (the “Website”), contact us, or apply for a job with us, and the choices and rights you have. It does not cover the work we do for clients under a separate agreement.

Information we collect

Information you give us

• Contact form and enquiries: your name, business email address, phone number, company name, the services you’re interested in, and anything you choose to write in your message. We ask for a business email address.
• Emails, calls and meetings: what you share when you correspond with us.
• Job applications: when you apply for a role, our application form (provided by ClickUp) collects the details you enter, such as your name, contact details, résumé, portfolio, work history and answers to screening questions.

Information collected automatically

• Device and usage information: IP address, browser and device type, operating system, pages viewed, links clicked, time spent on pages, the site that referred you, and the date and time of your visit.
• Approximate location: your city, region or country, estimated from your IP address. We don’t collect precise location.
• Cookies and similar technologies: identifiers set by us and by our analytics and advertising partners. See our Cookies Policy for details.
• Campaign information: when you arrive from an ad, email or link, we note the campaign details in the address (for example UTM parameters and ad click identifiers), the first page you landed on, the site that referred you and the date of your first visit. If you agree to analytics cookies (or, in the United States, unless you opt out), we keep these in your browser and include them when you send the contact form, so we know which campaigns bring enquiries.

Information from other sources

• Advertising and analytics partners (such as Google, LinkedIn and OpenAI) give us reports about how our ads and pages perform. These reports are mostly aggregated and don’t identify you.
• Our CRM provider (HubSpot) may add publicly available business information to an enquiry, such as company size, industry or website, to help us understand who we’re talking to.

We don’t knowingly collect sensitive personal information (such as financial account details, government ID numbers, health information or precise location) through the Website. Please don’t include it in messages or applications.

How we use your information

We use personal information to:

• respond to your enquiries and provide proposals and services you request;
• run, secure and improve the Website, including preventing spam and abuse of our forms;
• understand how visitors use the Website (analytics);
• measure and improve our advertising, including recording when an ad leads to an enquiry;
• show our ads to people who have visited the Website, on platforms such as Google, LinkedIn and ChatGPT, where the law allows and you haven’t opted out;
• consider you for jobs you apply for and communicate with you about your application;
• keep records, comply with our legal obligations, and establish or defend legal claims.

We don’t use personal information from the Website to make decisions about you that have legal or similarly significant effects based solely on automated processing.

How we share information

We don’t sell personal information for money. We share it with:

• Service providers who process it on our behalf under contract: Vercel (website hosting and file storage), Neon (website database), HubSpot (customer relationship management and website analytics), Google Workspace (email), ClickUp (job applications), CookieYes (cookie consent), and Google reCAPTCHA (form spam protection, where enabled).
• Analytics and advertising partners: Google (Google Analytics, Google Ads and Google Tag Manager), LinkedIn (Insight Tag) and OpenAI (ChatGPT ads measurement). These partners collect information through cookies and similar technologies on the Website and may use it for their own purposes as described in their privacy policies. Under some US state laws, this can count as “sharing” personal information for cross-context behavioral advertising or processing it for “targeted advertising”. You can opt out, as explained below.
• Professional advisers such as lawyers, accountants and insurers.
• Authorities and others when required by law, or to protect our rights, our clients, or the safety of others.
• A buyer or successor if we are involved in a merger, acquisition or sale of all or part of our business.

Your choices

• Opting out of sharing and targeted advertising (United States): use the “Do Not Sell or Share My Personal Information” link in the footer of every page and switch off advertising and analytics cookies. You don’t need an account.
• Global Privacy Control: if your browser sends a Global Privacy Control (GPC) signal, we treat it as a valid request to opt out of sale, sharing and targeted advertising for that browser, and our cookie settings show that your opt-out has been honored.
• Outside the United States: we only set analytics and advertising cookies if you accept them. You can change your mind at any time through the “Cookie Preferences” link in the footer.
• Marketing emails: you can unsubscribe using the link in any marketing email, or by emailing us.

Your privacy rights

US residents

Depending on the state you live in (including California, Colorado, Connecticut, Virginia, Texas, Oregon and other states with consumer privacy laws), you may have the right to:

• know and access the personal information we have about you, and receive a copy in a portable format;
• correct inaccurate personal information;
• delete personal information we collected from you;
• opt out of the sale or sharing of your personal information and of targeted advertising;
• appeal our decision if we decline your request; and
• not be discriminated against for exercising these rights.

We extend these rights to all US visitors, whether or not a particular law applies to us.

We’ll confirm receipt within 10 business days and respond within 45 days (we may extend this by another 45 days if necessary and will tell you if we do). To protect you, we’ll verify your identity by matching information you give us to what we hold, usually your email address. You can use an authorized agent; we may ask the agent for proof of your written permission and ask you to verify your identity directly. If we decline your request, you can appeal by replying to our decision with “Appeal” in the subject line; we’ll respond within 45 days. If your appeal is denied, you may contact your state Attorney General.

Visitors in the UK, European Economic Area and Switzerland

500 Designs LLC is the controller of your personal information. We rely on these legal bases:

• Consent for analytics and advertising cookies (you can withdraw it at any time through Cookie Preferences);
• Legitimate interests in responding to business enquiries, running and securing the Website, and recruiting;
• Steps before entering into a contract when you ask us for a proposal or apply for a job; and
• Legal obligation where the law requires us to keep or disclose information.

You have the right to access, correct, delete or restrict the use of your personal information, to object to our use of it, to data portability, and to withdraw consent at any time. You can also complain to your local data protection authority. Email hello@500designs.com to exercise these rights.

California notice at collection

The table below summarizes the categories of personal information we have collected in the past 12 months, why, and who we disclosed them to.

The sources of this information are you, your browser or device, and the partners described above. We keep each category only as long as described under “How long we keep information”. We don’t sell personal information for money; identifiers, internet activity and approximate geolocation may be shared with advertising partners for cross-context behavioral advertising unless you opt out. We don’t knowingly sell or share the personal information of anyone under 16.

How long we keep information

• Enquiries and client contacts: for as long as we have an active business relationship and for up to three years after our last interaction, unless we need it longer for legal or accounting reasons.
• Job applications: for up to two years after the role is filled, so we can consider you for future roles, unless you ask us to delete it sooner.
• Analytics data: no longer than 14 months in Google Analytics.
• Campaign information in your browser: until you clear your browser storage or withdraw consent.

International transfers

We are based in the United States and our service providers may process information in the United States and other countries. Where we transfer personal information from the UK, EEA or Switzerland, we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses or our providers’ certification under the EU-US Data Privacy Framework and its UK and Swiss extensions.

Security

We use reasonable technical and organizational measures to protect personal information, including encrypted connections (HTTPS), access controls and reputable service providers. No website or online service is completely secure, so we can’t guarantee absolute security.

Children

The Website is intended for businesses and isn’t directed to children. We don’t knowingly collect personal information from anyone under 16. If you believe a child has given us personal information, please contact us and we’ll delete it.

Links to other websites

The Website links to other websites, such as social networks and client sites. Their privacy practices are their own, so please read their policies.

Changes to this policy

We may update this policy from time to time. We’ll post the new version here and change the “Last updated” date. If we make significant changes, we’ll highlight them on the Website.
